These Terms of Use govern your use of the Heron Tai Chi mobile application (“the App”), provided by Batuhan Kaçmaz (“we”, “us”, “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Please read Section 2 carefully. It concerns your health and safety.
1. The Apple Standard EULA Applies
This App is licensed to you under Apple’s Standard End User License Agreement (EULA), the full text of which is available at:

The Apple Standard EULA covers the licence grant, restrictions on use, warranty disclaimers, limitation of liability, termination, and governing law. By downloading the App from the App Store you accept that EULA, and these Terms of Use serve as a supplement addressing our specific app and subscription terms below. In any conflict between Apple’s Standard EULA and these Terms, Apple’s Standard EULA prevails.
2. Health and Safety — Please Read
Heron Tai Chi is a general fitness and wellbeing app. It is not a medical device, and nothing in it is medical advice.
- The movements, plans, and guidance in the App are educational and general in nature. They are not a diagnosis, treatment, prescription, or a substitute for professional medical advice from your doctor, physiotherapist, or other qualified healthcare provider.
- Consult your doctor before you begin, especially if you are pregnant, recovering from surgery or injury, have a heart condition, high or low blood pressure, dizziness or balance problems, osteoporosis, joint disease, a history of falls, or any other condition that may be affected by physical activity, or if you are unsure whether exercise is safe for you.
- The setup questions ask about your goals, aches, sleep, and mobility so the App can pick gentler or firmer variations. These answers are used to personalise a general fitness plan. They are not a medical assessment, they are not reviewed by a clinician, and they cannot detect a condition that would make exercise unsafe for you.
- Practise within your own limits. Move slowly, use a chair or wall for support whenever you want it, and never push into pain. Stop immediately and seek medical attention if you feel chest pain, shortness of breath, dizziness, faintness, nausea, or any sharp or unusual pain.
- Choose a safe place to practise — clear floor space, non-slip footing, good light, and something stable within reach if you lose your balance.
- You take part at your own risk. To the fullest extent permitted by applicable law, you assume responsibility for the risks of physical activity, and we are not liable for injury, aggravation of an existing condition, or other harm arising from your use of the App. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.
If you are experiencing a medical emergency, call your local emergency number immediately. Do not use the App instead of seeking help.
3. Your Account and Your Data
The App creates an anonymous account for you automatically. There is no sign-up, and we do not ask for your name, email address, or password.
- Your progress is stored on our servers and tied to a random identifier held on your device.
- If you delete the App, change device, or reset your device without restoring it, you may permanently lose access to your practice history, because there is no email address or password with which to recover it. This is a deliberate consequence of not collecting personal information about you.
- Your purchases are separate: they are tied to your Apple ID, not to your anonymous account, and can be restored on a new device with “Restore Purchases”.

4. Free Content and Subscriptions
4.1 What is free
The first 3 days of the 28-day programme are free. Day 4 onward requires an active Pro entitlement.
4.2 Subscription products
Heron Tai Chi offers the following products through Apple’s App Store:
- Heron Pro Monthly — $9.99 per month, auto-renewable.
- Heron Pro Annual — $59.99 per year, auto-renewable, including a 7-day free trial for new subscribers.
- Heron Lifetime — $99.99, a one-time purchase. This is not a subscription and does not renew.
Prices shown are for the United States storefront. The price in your local currency, and any trial or introductory offer you actually qualify for, is shown in the App before you confirm the purchase. Prices may change; we will tell you before a change affects an existing subscription, and Apple will ask for your agreement where required.
4.3 Auto-renewal
- Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: Your subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Renewal charge: Your account is charged for renewal within 24 hours before the end of the current period at the price of your selected plan.
- Manage or cancel: You can manage your subscription or turn off auto-renewal in iOS Settings → your name → Subscriptions. Deleting the App does not cancel your subscription.
- Free trial: Where a free trial is offered, it converts to a paid subscription automatically unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you buy a subscription. Trials are limited to one per Apple ID, at Apple’s discretion.
We cannot cancel a subscription on your behalf — Apple manages billing.
4.4 Refunds
Refunds are governed by Apple, not by us, because we do not process your payment. To request one, use Apple’s “Report a Problem” page: https://reportaproblem.apple.com/.
If you are a consumer in the EU, the UK, or Türkiye, you may have a statutory right of withdrawal for digital purchases. Because the App gives you immediate access to digital content on purchase, that right may be limited once access begins, but you can still contact us at support@wearebasestudio.com and we will help you raise the request with Apple.
5. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law.
- Copy, record, redistribute, resell, or publicly perform the App’s video, audio, or instructional content.
- Use the App to teach paid classes or otherwise for commercial purposes without our written permission.
- Use the App in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to our servers, our providers’ servers, or other users’ data, or to circumvent the paywall or entitlement checks.
- Use automated tools (bots, scrapers) to interact with the App in a way that disrupts the service.
6. Intellectual Property
The App, its design, source code, text, graphics, video, audio, and trademarks are owned by Batuhan Kaçmaz or our licensors. Tai Chi as a practice and the Yang-style form are part of the public domain of human tradition; our particular instruction, sequencing, recordings, and presentation of it are not. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, subject to the Apple Standard EULA.
Feedback you send us is voluntary, and we may use it to improve the App without obligation or compensation to you.
7. Availability and Changes to the App
We aim to keep the App available, but we do not guarantee uninterrupted service. We may add, change, or remove features, movements, or programme content, and we may need to suspend the service for maintenance. If we discontinue the App entirely, we will give reasonable notice in the App where we can, and you may be entitled to a pro-rata refund of a prepaid subscription period through Apple.
8. Termination
We may suspend or terminate your access to the App if you materially violate these Terms or use the App in a way that harms us or other users. You may stop using the App at any time by uninstalling it, and you may cancel your subscription as described in Section 4.3.
Upon termination: - Your right to use the App ends immediately. - Your data is handled in accordance with our Privacy Policy — you can request deletion at any time, and we complete it within 30 days.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES, OR THAT IT WILL PRODUCE ANY PARTICULAR HEALTH, FITNESS, OR WELLBEING RESULT.
This disclaimer does not affect your statutory rights as a consumer in jurisdictions where such rights cannot be excluded.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
This limitation does not apply to liability for: gross negligence, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.
11. Apple’s Role
You acknowledge that these Terms are between you and us, not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claim relating to the App, including product liability, regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Governing Law
These Terms are governed by the laws of Türkiye, without regard to conflict-of-law principles. Mandatory consumer-protection laws of your country of residence still apply where they provide stronger protection.
For users covered by EU or UK consumer-protection law, you may bring proceedings in the courts of your country of residence; we may bring proceedings only in those same courts.
13. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Material changes will be communicated in the App before they take effect. Continued use of the App after a change constitutes acceptance of the updated Terms.
